Our experience and skill in mediation saves you time, money and the stress of a court proceeding.

What is mediation?

Mediation is an informal process that allows disputing parties to discuss options and create solutions for their particular set of problems. Unlike other forms of dispute resolution such as arbitration or courtroom trials, mediation is based purely on the parties’ abilities to think creatively and agree on those solutions that best work for them.

Mediation is a future-focused process that allows the parties to design their future rather than dwell on or try to repair the past. Compared to litigation (going to court), mediation is significantly less time consuming, less costly, less stressful and keeps the parties in complete control of the outcome. Unlike court, everything said is confidential and private; this allows the parties to be very creative in reaching a long-lasting solution.

Litigated disputes can take months or years to resolve and generally conclude with the decision of the judge. This can result in an outcome based on little-to-no input from the parties and typically leads to more litigation. Mediation, on the other hand, often leads to agreements and solutions that last for years.

Preserving relationships

In many cases, both parties are best served when they establish a cordial relationship. Through the structured process of mediation, you can set aside hostility and agree on key points to focus on in your particular case. Mediation can be a highly effective tool through which you can resolve differences and save time and expense. The predictability of mediation reduces the stress of legal conflicts and puts important decisions in your hands, rather than in that of the court’s rulings.

What does a mediator do?

The mediation process is guided by a neutral party, the mediator, who ensures the process remains fair and balanced and that the concerns of all parties are discussed and addressed. But the mediator does not make any decisions, nor does he or she offer legal advice during the mediation process — even if the mediator happens to be a licensed attorney. The mediator presides over the process, but the parties are responsible for the terms of their agreements.

Helping individuals resolve their legal disputes amicably

Mediation gives you control over the process and can often provide more expedient, predictable results than going to trial. Daniel K. Habenicht, PLLC is a skilled and experienced mediator who can help you obtain the best possible settlements while preserving amicable relationships.
